Licensing Applications (business premises)-Premises Licence, Wedding Licence,

The UK law is constantly changing and we strongly advise you to obtain professional legal advice whether you’re making an application for a premises licence under Section 17 of the Licensing Act 2003 or applications to vary a licence under Section 34 of the Licensing Act 2003.

We can prepare and submit your application as well as represent you at a Licensing Sub Committee hearing.

PREMISES LICENCE: PREPARE AND SUBMIT AN APPLICATION

We charge a fixed fee of £1500 + VAT + Expenses to prepare and submit an application for a new Premises Licence.

Additional charges

In the event there are additional charges we will advise you as soon as possible. The following factors may result in charges over and above our fixed fee and the additional time will be charge at an hourly rate of £x:

  • Larger premises
  • If the premises are in a Cumulative Impact Zone
  • The number of objections to the application
  • Whether attendance at local meetings is required
  • Whether multiple applications are being made – for example, regulated entertainment and the sale or supply of alcohol.
  • The extent of consultation required with responsible authorities.

Disbursements

Disbursements are costs payable to third parties. We handle the payment of disbursements on your behalf.

*The Premises Licence Fees are payable to the local authority and vary depending on the non-domestic rateable value of the premises. You can find this information from the Valuation Office Agency [LINK http://www.voa.gov.uk/business_rates/index.htm]

  • Band A – No RV to £4,300 = £100.00
  • Band B – £4,301 to £33,000 = £190.00
  • Band C – £33,001 to £87000 = 315.00
  • Band D – £87001 to £12500 = £450.00*
  • Band E – £125001 and over = 635.00*

For premises with rateable value Band D or E which are primarily used for the consumption of alcohol on the premises, there is a higher fee:

  • Band D – £7001 to £12500 = £900.00
  • Band E – £125001 and over £1,905.00

Exemptions

The provision of regulated entertainment at church halls, chapel halls, village halls, parish or community halls, or other premises of a similar nature are exempt from fees with the cost being met by central Government. However, if the licence also authorises the supply of alcohol or the provision of late night refreshment, a fee will be required.

Schools and sixth form colleges are exempt from the fees associated with the authorisation of regulated entertainment if the entertainment is provided by and at the school or college and for the purposes of the school or college.

Time Scales

You can expect your application to take between 1 – 3 weeks to prepare after we’ve received your instruction.

For more complex applications or if there is substantial opposition to the application you can expect a longer time frame. We will discuss any changes to timescales with you.

Key Milestones

These are the typical steps we’ll take to obtain your licence.

  • Take your instructions and advise you on your application
  • Advise you on the plans you are required to submit with your application.
  • Complete the application form for a new premises licence (including the operating schedule) and submit this to the local licensing authority with suitable plans (which you must provide).
  • Provide guidance on the fee levels payable to the licensing authority.
  • Prepare copies of the premises licence application for disclosure to the responsible authorities and serve copies of the application on the responsible authorities.
  • Draft the notices to advertise the premises licence application and submit the notice to the local newspaper.
  • Arrange for you to display the notice(s) advertising the premises licence application and advise on compliance with the Licensing Act 2003.
  • Provide a Designated Premises Supervisor (DPS) consent form for signature by a personal licence holder (proposed by you).
  • Check the licence and correct any errors with the licensing authority.

REPRESENTATION AT A LICENSING SUB COMMITTEE

We charge a fixed fee of £1000 + VAT if your application goes to a Licensing Sub-Committee hearing and you require representation.

What’s included

  • Consider the papers.
  • Attend and represent you at the hearing.
  • Advise on appeal (if appropriate).
  • Confirm the outcome of the hearing in writing.

What’s excluded

Travelling expenses for sub-committee hearings outside Greater London are not included.
